Welcome to Goldfields Painters. These Terms and Conditions (“Terms”) govern the agreement between Goldfields Painters (“we,” “us,” or “our”) and the client (“you” or “the Client”) for the provision of painting, decorating, line marking, and related maintenance services.
By accepting our quote, paying a deposit, or authorizing us to commence work, you agree to be bound by these Terms.
1. Quotes, Scope of Work, and Acceptance
- 1.1 Validity: All quotes provided by Goldfields Painters are valid for thirty (30) days from the date of issue, after which they are subject to review or alteration.
- 1.2 Scope: The scope of work is strictly limited to what is explicitly detailed in the written quote. Any variations, additions, or modifications requested after acceptance will be treated as a variation under Section 6.
- 1.3 Acceptance: A contract is formed, and these Terms are accepted, upon the Client providing written confirmation (via email, text, or signed document) or upon the payment of any requested deposit.
2. Pricing and Payment Terms
- 2.1 Fixed Pricing: Prices quoted are based on the costs of materials, labor, and operational expenses at the time of quoting.
- 2.2 Payment Schedule:
- Residential Projects: A deposit may be required prior to the commencement of works. Progress payments or final payment is due strictly upon completion of the project, unless otherwise agreed in writing.
- Commercial & Industrial Projects: Payment schedules, including progress claims, will be outlined in the specific project contract or quote.
- 2.3 Late Payments: We reserve the right to charge interest on any overdue invoices at a rate of 2% per month, calculated daily from the due date until paid in full. The Client will also be liable for any legal or collection costs incurred in recovering overdue amounts.
3. Client Obligations and Site Access
- 3.1 Access: The Client must provide clear, unimpeded access to the property, including power and water utilities, during our standard working hours (or hours explicitly agreed upon for commercial/night works).
- 3.2 Clear Space: Unless explicitly included in the quote, the Client is responsible for moving all furniture, vehicles, fixtures, and personal belongings away from the work areas before work begins. While we take every care, we accept no liability for damage to items left in the designated work zone.
- 3.3 Council & Permits: The Client is responsible for obtaining any necessary council approvals, permits, or specific clearances required for the site, unless explicitly negotiated otherwise (e.g., specific commercial parking lot closures).
4. Materials and Quality Standards
- 4.1 Premium Materials: Goldfields Painters guarantees the use of premium, Australian-standard paints and materials suited to the harsh climate conditions of Kalgoorlie-Boulder and the wider Goldfields region.
- 4.2 Standards: All workmanship will be performed by qualified professionals in accordance with the standards set by Master Painters Australia and standard Australian painting industry practices (AS/NZS 2311:2017 Guide to the painting of buildings).
5. Delays and Environmental Factors
- 5.1 Weather Delays: Exterior painting and line marking are highly dependent on weather conditions (including extreme heat, rain, and high winds common to the Goldfields). Goldfields Painters reserves the right to delay works if environmental conditions compromise the safety of our team or the quality and longevity of the finish.
- 5.2 Indirect Delays: We are not liable for project delays caused by factors beyond our reasonable control, including but not limited to material shortages, severe weather events, structural defects discovered during preparation, or delays caused by other trades on site.
6. Variations and Extra Work
- 6.1 Variations: If you request changes to colors, finishes, or additional areas to be painted after work has commenced, or if hidden defects are discovered during surface preparation (e.g., dry rot, severe water damage, hazardous lead paint), a Variation Order will be issued.
- 6.2 Pricing of Variations: Extra work will be quoted and charged in addition to the original contracted price. Work on the variation will only proceed once the Client provides written or verbal approval.
7. Warranties and Defect Rectification
- 7.1 Workmanship Guarantee: Goldfields Painters stands behind its work with a standard warranty on workmanship, ensuring a durable, reliable finish. This warranty does not cover damage caused by building movement, structural shifting, moisture ingress from structural faults, third-party damage, or general wear and tear.
- 7.2 Inspection: The Client must inspect the completed works alongside our team lead upon practical completion. Any defects or areas of concern must be reported to Goldfields Painters within seven (7) days of project completion so we can rectify them promptly.
8. Insurance and Compliance
- 8.1 Industry Registration: Goldfields Painters is fully registered and accredited with Master Painters Australia.
- 8.2 Coverages: We maintain comprehensive Public Liability Insurance and appropriate Workers’ Compensation insurance to ensure your property and our team are fully protected throughout the duration of the contract.
9. Cancellation Policy
- 9.1 Cancellation Notice: If the Client wishes to cancel or indefinitely postpone a scheduled project, written notice must be provided at least forty-eight (48) hours prior to the scheduled start date.
- 9.2 Non-Refundable Costs: If a project is cancelled after materials (such as custom-tinted paint or specialized commercial materials) have already been purchased specifically for your job, the Client remains liable for the cost of those materials.
10. Governing Law
These Terms and Conditions are governed by the laws of Western Australia (WA). Any disputes arising from this agreement will be handled within the jurisdiction of Western Australian courts.
